Terms of use

The purpose of these Terms of Use (hereinafter the "Terms"; in French, Conditions Générales d'Utilisation or "CGU") is to define the terms and conditions under which EI Start-Win (Start-Win), publisher of the Zeste service available at https://zeste.cooking, makes its online recipe management and import application available to the user.

Accessing and using the service implies unreserved acceptance of these Terms. In the event of a conflict with the Terms of Sale on pricing matters, the Terms of Sale prevail for paid subscriptions.

Zeste allows users in particular to:

• import recipes from a URL, a photo, a text or a file;
• automatically extract ingredients, steps and related information;
• translate and adapt recipes to the account's language;
• view, edit, organize and cook recipes (step-by-step mode);
• share a recipe via a dedicated link;
• subscribe to a Pro subscription to lift the limits of the free plan.

Start-Win reserves the right to change the features, interface or technical limits of the service, provided that it informs users when the change is substantial.

Using Zeste requires creating an account with a valid email address and a password. The user undertakes to provide accurate information and to keep it up to date.

The user is responsible for keeping their login credentials confidential and for any activity carried out from their account. If unauthorized access is suspected, they must inform Start-Win without delay at robin@start-win.fr.

The service is intended for natural persons of legal age or legal entities with the legal capacity to enter into contracts. A minor must be registered under the responsibility of their legal representative.

Zeste offers a free plan with weekly import limits: 5 video/link imports per week, 2 photo imports per week, 10 text imports per week, 10 file imports per week. These limits may be revised; the values in force are displayed in the application.

Start-Win may suspend or limit access in the event of abusive, automated or fraudulent use, or use contrary to these Terms.

The user remains responsible for the content they import, store, edit or share via Zeste. They warrant that they hold the necessary rights to this content and undertake not to infringe the rights of third parties (copyright, neighboring rights, trademarks, privacy).

Importing protected content from third-party platforms (Instagram, TikTok, YouTube, recipe websites, etc.) must comply with the terms of use of those platforms and with lawful personal use. Zeste is not affiliated with these services and claims no rights over the source content.

The user grants Start-Win a non-exclusive, worldwide license, limited to the lifetime of the account, strictly necessary for hosting, technical processing, AI extraction, display in the interface and, where applicable, sharing enabled by the user.

Some Zeste features rely on artificial intelligence models to extract, structure or translate recipes. The generated results are provided as assistance and may contain errors (quantities, ingredients, allergens, times, units).

The user must always check the information before any food use. Start-Win cannot be held liable for the consequences of a recipe that is incorrect, incomplete or unsuitable for a particular diet.

The user may, if they wish, make a recipe accessible via a sharing link. They remain solely responsible for the content shared and may revoke sharing at any time by deleting the link or the recipe.

Recipients of a sharing link can view the recipe according to the features offered by the service at the time of access.

Start-Win strives to keep the service available 24 hours a day, 7 days a week, subject to maintenance operations, updates and constraints related to third-party providers.

The service may be temporarily interrupted without notice for security reasons, in the event of force majeure or of a malfunction attributable to a third party.

The processing of personal data is described in our privacy policy. Data is hosted in compliance with the applicable obligations. The user can request the deletion of their account by contacting robin@start-win.fr.

The user can delete their account at any time from the settings or by request to Start-Win.

Start-Win may suspend or terminate an account, without compensation, in the event of a breach of these Terms, non-payment of a Pro subscription, fraudulent use or a risk to the security of the service or of third parties.

In the event of termination, access to the hosted recipes may be removed in accordance with the retention policy in force.

To the extent permitted by law, the liability of Start-Win is limited to proven direct damage resulting from a proven fault in the performance of the service.

Start-Win is not responsible for content imported by users, for decisions made on the basis of extracted recipes, or for unavailability or changes imposed by third-party services.

Start-Win may amend these Terms at any time. The version in force is the one published on https://zeste.cooking. Continued use of the service after the changes are published constitutes acceptance of the new Terms.

These Terms are governed by French law. In the event of a dispute, the parties will endeavor to find an amicable solution. Failing that, the matter will be brought before the competent French courts, subject to the mandatory consumer protection rules.
